TRANSMISSION OF ORDERS VIA ELECTRONIC SYSTEMS

 

When the Client obtains from the Company or third party executors of the Company's orders with which the Company cooperates appropriate Software to send its orders either to the Company either directly to the Executing Firm or to the execution venue (hereinafter referred to as "electronic orders"), the following terms shall also apply:

 

The transmission of orders through electronic systems requires the Client to use a combined username and password, which are sent by post in a confidential letter. Both the Company and the software provider may from time to time require the change of the User and/or Access Code and reset the password in order to protect the Client's transactions; they are not responsible for any damage suffered by the Client in the event of failure to execute transactions until the completion of the relevant procedure. The Client accepts that the username and password combination represents and completely substitutes his/her signature in any electronic transactions he/she makes; it also constitutes a presumption of use of the service, confirms that the electronic order comes from the Client himself, and that the information was communicated to the Client himself. The Client must keep the username and password assigned to him/her secret. In the event of their theft, loss, illegal or improper use, the Client must inform the Company immediately, otherwise they are fully bound by any transaction and are liable to the Company or the Provider for any damage that may arise.

 

The Company shall not be responsible for any problems or damage to the Client arising from external factors such as, but not limited to, damage to electronic systems, communication lines, telephone lines or electronic links (e.g. failure to connect to the INTERNET (ISP)). The Company shall also not be responsible for the security of the Client's systems, as well as illegal access to and use of the software or personal data of the Client (Hacking) by third parties. It shall also not be responsible for any losses incurred by the Client in the event of a personal identification number or password being leaked for any reason or in the event that third parties access the Client's accounts by using the Client's personal identification number and password and other details. Furthermore, the Company shall not be liable for any damage suffered by the Client in the event of interference or attempt to interfere with the Company's network on the Internet, or in the event of non-operation of the system for reasons not resulting from gross negligence or willful misconduct of the Company.
